Health Law

Our health law attorneys help their clients successfully navigate the complex regulatory landscape that governs nearly every aspect of their health care operations. Our clients include physicians, hospitals, freestanding ER centers, and many other types of health care providers, as well as health related joint ventures that include physician and non-physician investors, which are highly regulated.

We have extensive experience in the areas of Medicare and Medicaid program compliance, including compliance with the federal Stark law and anti-kickback statute, the Texas corporate practice of medicine doctrine, and an array of other federal and state health care laws.

Our health law attorneys also have extensive business law and employment law experience and can efficiently represent clients needing representation in these areas. We frequently advise clients in forming and structuring professional entities and health care joint ventures to best meet their business needs in a way that avoids regulatory violations. We routinely represent health care clients in employment law matters, including non-competition restrictions, the preparation, negotiation and termination of employment contracts, compliance with employment laws, and wrongful termination matters.

One function of our health law services is to identify potential legal compliance issues unknown to our clients, which occurs frequently due to the complexity and sheer volume of health laws governing our clients’ operations. Once identified, we advise our clients of potential options for pursuing their goals in a way that ensures compliance with applicable law.

Importantly, our experience in representing health care providers means that our health law attorneys are well versed in the practical challenges our clients face and the environments in which they operate, meaning our attorneys frequently understand our clients’ complex issues and challenges quickly so they can proceed to address their needs.
