Tracey M. Smith

Tracey advises clients on all aspects of Employment Law (including physician employment and certain corporate and health care regulatory matters), including federal and state regulatory and compliance matters. She has represented clients in myriad administrative employment maters, including Fair Labor Standards Act (FLSA) matters, Texas Workforce Commission hearings and appeals, employee training, and the preparation and analysis of employee policies and procedures.

Tracey has also advised clients on the resolution of employment claims including discrimination, harassment, wrongful termination, retaliation, and non-compete claims; conducted employment investigations, including embezzlement and other criminal investigations; and developed procedures for and counseled clients on implementing reductions in workforce and early retirement incentive programs. Tracey routinely prepares, negotiates, and advises public and private employers on a variety of contractual matters including executive employment agreements, independent contractor agreements, confidentiality agreements, severance agreements, and non-competition provisions.
